DBS Checks

DBS Checks are carried out - and must be carried out - for anyone who wishes to work with children, the elderly or individuals who might otherwise be classed as vulnerable.

The Disclosure and Barring Service (DBS), is able to provide information about an individual as to whether or not he or she has a criminal conviction or has been charged with a criminal conviction which has expired.

This information is gathered from a number of sources and collated by the Disclosure and Barring Service (DBS), who will provide the applicant with what is known as a 'disclosure'.

This disclosure - as we have already mentioned - enables a prospective employer be they a school, residential or children's home or any institution where children, the elderly or vulnerable people reside, to decide for themselves if an applicant is suitable for employment.

Given recent upturns in certain crimes against the self; assault, sexual assault, child abuse etc, the demand for Disclosure and Barring Service (DBS), checks have increased dramatically.

When applying for a job the employer may well pay the cost of acquiring this disclosure or you may be asked yourself to pay for it and will be reimbursed if you are successful in your application for a job.

The DBS disclosure falls into three categories:

  • Standard
  • Enhanced Disclosure
  • Enhanced with List Checks

Standard Disclosure

A basic disclosure is just that; it gives the relevant information about an individual and whether they have any spent convictions. A spent conviction is a conviction that is no longer held as a matter of importance. These convictions - depending on the severity of them - should have been wiped from your file after ten years. Information also included is date of birth, nationality, address etc.

Enhanced Disclosure

An enhanced disclosure will show everything relating to arrests and convictions and any other information that the police or other law enforcement agencies may hold in relation to you.

Your situation may be slightly different. ask a question below ↓ and our editorial team will reply with our advice.

Enhanced with List Checks

This will check whether someone’s included in the 2 DBS ‘barred lists’ (previously called ISA barred lists) of individuals who are unsuitable for working with children and vulnerable adults. There is also an area within the Enhanced DBS Check process where local police can add any relevant information they may hold about the applicant.

It is worth mentioning that if you are being employed as a nanny, au pair or childminder by a private citizen that they have no legal obligation to approach the Disclosure and Barring Service (DBS) for a disclosure. If you are to be employed or are applying for positions where you will be answerable to a private citizen then it is your responsibility to provide them with an up to date DBS check.

If however you are being employed by a government body or large organisation then they are responsible for seeking this disclosure - after having informed you of their intent to do so - and may under law seek to gain an enhanced disclosure which will detail all offences, charges or arrests leveled against you spent or otherwise.

It is worth remembering as well that if you were cautioned by the police for whatever reason - should it even have been a caution received as a minor - this too will show up on your DBS record.

The Disclosure and Barring Service (DBS, checks carry no time limit so if you apply for a vacancy and do not get it and then apply for another position you may be asked to provide a new DBS disclosure; this is done to provide one hundred per accuracy for the following reason; you may have been awaiting arrest or conviction for an offence at the time of your previous disclosure and these will not show up so employers will tend to ask for a new disclosure if there is a significant period of time has elapsed since the last one's issue.

@Vajira Yes, foreign nationals can apply for a DBS check, but only the organisation you're volunteering with can request it on your behalf, you can't apply for a standard or enhanced one yourself. The check will only cover any UK criminal record, so most charities will also ask for a police certificate or equivalent from your home country to cover the years you lived there. If you've been in the UK less than 5 years, expect them to want overseas references too. Worth chatting to the volunteer coordinator early, as the paperwork can take a few weeks.

8 years ago I tried to kill myself and so I was arrested for carrying a knife (which I only used on myself), as a result I was given a caution (the arresting officer felt it was unnecessary and detrimental to my state of mind at the time but his supervisor insisted I be cautioned). 7 years ago I was cautioned again for a domestic fight.
My life is now completely different to what it was back then to the extent it doesn't even seem truthful talking about these incidents. However I am applying for a new job working with parents and their babies at a play group. Will my cautions show on an enhanced DBS check? Or will they be omitted as it was over 6 years ago?

Can anyone explain please, my x husband was found guity of assault 2 years ago, against a former partner. He lost his crb so couldn't drive children to school. However I have found out his employer is letting him still drive,he has now assaulted me, and was given a cauction, as I took it no further, as he already has a criminal record.

I have a current DBS for adults and children but an employment agency wants me to fork out for another check but only for children. It doesn't make sense. Doesn't my Child and Adult DBS check cover me for children?

I’m currently going through a situation. My brother and I had a fight, I didn’t give a statement against him or show my bruises. He has shown his scratches and given two statements. I’m now at risk of being charged. I’m shocked to say the least, I also work with children and he knows he could ruin my career. Baring in mind he is a lot bigger and stronger than myself, I still did not want to get him in any trouble. Now here I am, in trouble. Any advise is much appreciated, I’m losing the will here!

Hi So when I was 16 I was found guilty of GBH without intent and I was told I would have to go to youth offenders for 3 months and my recorded would be wiped away. im going to university and I was told for my course they are gonna need to do a dbs check on me and I was wondering if this going to show up on my recorded

In 2010 i was wrongly arrested after a fight broke out in a pub, it all went to court and after viewing cctv i was cleared, then at the last minute the police decided to bring a charge of assaulting a police officer while i was at the custody suit! They had also lost any cctv from the custody desk! What acually happend was they grabbed me from behind which i wasnt xpecting and i flung my arm up and accidently caught the arm of the officer. My barrister advised me to plead guilty as because they had got everything else about the case wrong they had to be seen as justifying my arrest and my word against the police wouldnt uphold. I ended up getting a small fine.
The problem is i work in a school and my dbs has just rolled on so i never mentioned it but now our employer is changing to a new one and i need a new dbs check. Am i going to loose my job now? Any help appreciated. Thanks.

I got convicted for common assault against my brother for threating my elderly dad and was given 120 hours community payback.how my own family could ruin my dreams of working with children I worked in a nursery for a week with my girlfriend and have a baby of our own. I have volunteered to coach my kids football team, many years ago I was cautioned for ABH split an idiots lip who attacked me. Will this prevent me from coaching kids? I think it’s rediculous that something so minor will show up on a DBS check ?????

Unfortunately I had to put my daughter in to voluntary care . She now now at the centre of a police investigation in to allegations that she has been groomed and raped . I have just applied at a school and have an enhanced check but the police have raised a conflict wanting more information about the job role . I have asked why with no answers back . Can this be put on dbs as other information

Hi. I work as a model for artists. I have been offered a job with sixth form students. Two years ago I was cautioned for common assault after being harassed by security staff and defending myself to be quite frank! I believe it will show on a dbs check as within six years. If I tell the school can they still employ me? It is a three session job only but all work is precious as leads to further work. Please advise asap. T.y.

I have applied for a job at a nursery and recently applied for a subject access disclosure which has come back showing 2 arrests for ABH back in 2007. I have explained to the nursery of the arrests and circumstances at the time in which I was in a violent relationship and when he was arrested along with his mother made counter allegations against me resulting in my arrest. The outcome for me was no further action. I have 7 children of my own. Will this stop me from working in a nursery and progressing on to teaching assistant?? My enhanced DBS has been applied for by the nursery x

Hi there the question I have is I have got a conviction for common assault which I got 12 months probation for it which happened 20 years ago at the time I was have a break down due to the loss of my bother dieing and I was on tablets I hit rock bottom the question I have is this conviction happened at my ex work place which they shut down I then found another job which I have been working for over 6 years I do kids party's now and then not very offen I am a caretaker and now every single member of staff as got to have a DBS check which I have now done it it a enhanced one at the time I disclosed my spent conviction and was told it will be fine could I lose my job over it even though I have worked for the company for more than 6 years I am one of the best staff they have any help or advise I would be greateful

@Oli - it would have come up before now if it was going to come up. Although if it has previously come up, it will always come up and I don't think on an advanced search such things are classed as spent.

I was cautioned around 10-12 years ago for possession of drugs. Will this still come up on a dbs check? I have been a teacher for over 10 years now and wondering if I will always need to disclose ?

Hi.

I applied for a job as a cleaner in a secondary school. My DBS just arrived and I got a conviction for GBH in 1999. I handed over my DBS to HR and they said the Head Teacher will have to make a decision if I get employed or not. The conviction was 19 years ago and I haven't been in any trouble since.

I just hate waiting I'm hoping someone can let me know if they will be able to hire me with this conviction. I don't think I would be able to but why did HR say the head has to make a decision if she knows there's no chance of getting the job.

@Animalmagic - A standard DBS check will not show an arrest, a standard DBS checks will search for cautions, convictions, warnings, and reprimands only. On an Enhanced DBS check there is a section where the police can add other relevant information that they feel is important. Your local police force might decide that it's in your employer's interest to know about an arrest or something that the police have logged.

Ive had a messy divorce. My ex husband made some false allegations resulting in letters from the Multi agency safeguarding hub, with no action. My youngest daughter is currently considered a child in need. I also received a community resolution as a result of my older daughter repeatedly assaulted me & I knocked her spectacles off her causing a small bruise. I realise all this sounds awful & that I am not fit to work with children. I currently work with children, I have been open about my circumstances. I am applying for another job with children but am worried about the DBS. I am having counselling where I am addressing these & other issues plus the route cause of my actions. Please could you answer my concerns.

Hi.. I work with vulnerable adults. The father of my children got full custody as I did not attend court as he told me we didn't need to go and we could sort it out. He tricked me. However he got full custody. Will this affect my dbs?

Hi, I am a new dance company/ teacher who is planning on running a local dance class for under 16's. I have been advised that I would need a supervisor or another adult present so I am alone with the children.

Would this supervisor need to have a DBS, or at least a recent one? Or would me having DBS be enough?

Hi, 5 years ago July I sent my ex partner a text telling her that interest was due to be going on the loan I took out for her, and made her aware of the money she still owed me. We had been in contact since we split in the January. 2 police officers turned up at my house and said my ex said I had been stalking her for months and sending texts. They issued me with a harassment order.
I was So upset and stupidly went to me ex's house to ask why she would do this to me. Her friend rang the police and I was arrested, thrown in a cell, interviewed and cautioned. I sent an appeal to the IPCC. I found out that the police didn't see any texts, plus I had been to see my ex in hospital by request only 2 weeks before and had signed in. She had been sectioned for bi polar disorder and was on a cocktail of drugs.
An inspector rang me and basically talked me out of proceeding as I would get the officers in trouble. That was not my intention. I just wanted to hilight that that there was other information that needed to be considered. I didn't get anywhere and the caution stood.
I would like to do some voluntary work on a farm. I know DVB checks are carried out as children go to the farm for days out to see the animals.
Will my caution stop me from working here. Caution was issued July 2013.

Any info will be much appreciated.

Hi. I was in a relationship with my ex for 13 years. Near the end of our relationship he started drinking heavily and became violent. The last time he got me was confront of our daughter. I took her, left and called the police. The police called ss as I'd been honest and told them it was witnessed by my daughter. Ss came and because I was extremely anxious (terrified of being on my own) they thought I may go back to him (I didn't) but they stuck around. My ex tried everything to hurt me. Accusations that I was a prostitute and alcoholic and that I neglected my children. This of course was disproved and he later admitted to making them up. But before it was disproved, my kids were put on a cpr. It was explained to me that it was just a way to help me settle into my new life and gain confidence and that was fine. I did what they asked and I've had no dealings with ss for years. I'm now happily married to a lovely new man and have had another 2 children. After everything that happened I want to work in social services as I don't think I was treated fairly. I want to become a social worker. I start university in september. But I have recently started volunteering at a special needs venue for adults and kids with mental Illness. I'm terrified my DBS will show my kids were on the cpr. Will it show? Everyone I work with knows my story but I've never had much to do with the big boss and he's the one I have to answer to so he doesn't know much about me. Am I basically wasting my time studying for something I can never be. I will add that my kids were never taken away from me and I was given full custody

Hi, I called the police last April on my partner. He had a bit of a mad episode, random accusations and I couldn't calm him down (he was drunk) first incident, in over 10 years together and nothing lime this has happened since. I did slap him in the argument as he was saying some pretty horrendous stuff. No warnings or cautions were given to either of us. I have been offered a job in a primary school. Would this show on the local police search? Many thanks for any help

@Paul - If as a self-employed individual you require one, depending on the sector you work within and if you meet the criteria, you can do so through the local authority or a governing body. For example, if you are a self-employed child minder, you would require an Enhanced check you could apply via Ofsted.

I am a qualified teacher wanting to set up a business as a science tutor trading as a sole trader. If pupils come to me do I need a DBS check. Obtaining an enhanced DBS check with barring as an individual seems to be impossible.

Hi. I am a qualified headteacher but am currently not working due to a serious illness in the family. I am considering becoming a voluntary director of the local preschool which is a community interest company. If something happened at the setting, particularly if a safeguarding issue, would it stop me being able to be employed in schools when I am able to return to work as my name would be listed on Company’s House? Hi, 2 years ago I falsely took some points for speeding for my partner (stupid I know) to cut long story short we were caught out and was convicted to perjury :( I have not been in trouble with the police before or since but have now applied for a job for the local council withing school kitchens. Will this effect my employment when my dbs comes back? Thanks

@Kat - unfortunately, a conviction for assualt will appear on your DBS check and will not be spent.

I had an alcohol problem and lashed out at a police man things went bad to worst and when in the cells chucked water at a dentin officer I have several convictions for common assault the lowest former of assault in have turned my life around and want to work with vunerable people will this stop me please help

@Jaz - Yes, the school can refuse to allow you to hire the hall if shws up on the check. The school needs to be seen to be squeaky clean.

Hi there, 5.5 years ago I was arrested and cautioned for possession of a class A drug. I am now hiring a school sports hall where I will be taking indoor football lessons for children aged 6 - 16. The school are asking for an Enhanced DBS, but I know that the caution shows on the certificate. Can they refuse the hire of their hall because of this? Please help.

I am currently working for a company that is in partnership with school. I have received my DBS back today and it shows a warning from when I was 13 for assault I am now 28 and have not been arrested or cautioned since could this lose me my job?

Arrests don't count as anything if no further action is taken but if they are charged then it may show up because that means they have enough evidence to take it to court. I still wouldn't expect it to though and definitely a caution is only given if you are deemed guilty of something so that's very different. In any case, things showing up on a record check don't automatically disqualify you unless you are on the barred list for working with children which anyone found not guilty wouldn't be so he might have to just explain it to HR...

I live on a holiday park and am just wondering if staff should have these checks as they are working around children.

I don’t believe any have and there has been an incident recently on the park.
If they should have how can I find out if any have had these checks.

I work at a company where the employees have been asked to apply for DBS enhanced certificates. One particular employee hasn't handed his in, making out that he hasn't received it. The employer seems reluctant to enforce apart from taking him off jobs including children. Although I am sure whatever is on the certificate will not pose him as a risk to children and vulnerable adults. If something did happen in the future, would the Directors be personally accountable through the courts as they have not chased the certificate ? Just looking for ammunition to make them see sense.

I have been out if work for a number of years as a stay at home mum, i wanted to do volunteerung at tbe local school but they have asked me to get a enhanced dbs myself, as they wont apply for one,. Can anyone advise where i can get one done for myself

@Steve - As a rule, your santa does not meet the 'frequency and intensity test' To be eligible, your santa would have to be doing the same activity at least once a week, or at least four days in every 30-day period.

I have just taken over a job managing a large shopping centre. The Current Operations manager grows a beard and dresses up as santa each year. No grotto. Just wonders round saying hi, hope youve been good with lots of photos taken. He also mingles with our craft workshop for kids. He doesnt have a disclosure. Does he need one. Thanks

Hi, I was charged 9 years ago with child cruelty, after domestic abuse broke at my home where my child was present. Nothing ever came of this, no follow ups from any services, I was not placed placed on any barring etc. And no problems ever since. Will this show up on a DBS check? I have had a new job offer which needs one, do I open up to the employer? I am stuck in what to do best. Thanks

I have been working for a company who stated they had a completed and clear DBS check which they had requested from DBS, however after deciding to leave I checked with DBS and no application had been made by the company. Where do I stand with this I am thinking of contacting Ofsted as this is a serious breach of safeguarding.

After years of working in care and re training I am working as a teaching assistant for a council agency, I've been for an interview for a different agency to try and make up my work hours and they have said depending on refs, DBS ect. for the first time for me I have been asked to fully pay for the DBS without a guarantee of hors and without it being paid back after a length of time or such. I know passing the DBS will not be a problem as I've had so many over the years, I was going to personally apply to have the police check but the agency have said I must have it through them and pay to them or I wouldn't be able to work for the company, this doesn't quite sit right with me and I was wondering if that's right or if I completed a DBS myself that should sufficient.

Before including non-conviction information on a person's DBS certificate, the police must ‘reasonably believe’ that the information is relevant and that it ought to be disclosed. Your friend could make a subject access request to the police to find out what information they hold about them

Hi 4 years ago a friend got wrongingly charged with GBH without intent didnt go to jail tho. Couple of weeks later all charges got dropped will that be on her CRB check as she has applied to work in care industry.

If you are being officially employed to care for your grandchild, which will explain more. You can only check someone else’s criminal record when they apply for certain roles, for example in healthcare or childcare.

Good Afternoon,

My daughter has applied for a job at a Montessori School,
Her children were taken off her 3 years ago and my sister has a SGO and looks after my grand children.
My daughter was never convicted or cautioned of anything and sees her children on a regular basis.
Would anything show up on a DBS check, as she has tried so hard to get a job and if she does she can apply to revoke the SGO.

If you are applying to work with children or vulnerable adults then the police will reveal anything on your record as part of your DBS check if it feels it is necessary for your prospective employer to know. Plus, if it thinks it is relevant to the job you are applying for.

Hi. I was accused of going to bed with a girl under the age of 16 when I was about 21. She was 15 . I had to go to police station and they asked me about it but then told me that she had admitted making it all up . I am now 53 and have not been in trouble since . I work sometimes as a cleaner and about 10 years or so ago worked in a school and they said they had done a check on me and said I would have to give that job up and do a non school job . Would that false accusation still be on record as it has on a few occasions lost me work and I have done nothing wrong.

Hi, My daughter got involved in a wrong crowd when she was 14 years old, she went missing twice and the police had to find her to bring her home, to my knowledge she was never actually arrested, although they did also think that she was in early stages of being groomed or vulnerable to it. She has thankfully snapped out of that and has recently applied for an apprentice role at a nursery, is this information likely to be shown and if so, in your professional opinion would it be likely to cause the nursery concern with regards to taking her on?

It is unlikely you will be allowed to work with children if your DBS check has been returned with such convictions. Any official body who employs people to work with children have to cover themselves and protect the children in their care by ensuring all employees are DBS checked. As specified in the article, if you were being employed as a nanny, au pair or childminder by a private citizen, your employer has no legal obligation to approach the Disclosure and Barring Service (DBS) for a disclosure.

I have recently been successful in getting a role working with kids however my DBS has come back with 3 previous convictions (possession of a bladed article, robbery & fraud) the last one being in 2012 when I was 16.
However I worked for a year (2015-2016) as a Nanny in which I didn't need a DBS check and also have an amazing reference from my previous employer. What are my chances of getting this new job?

i want to work with special needs kids but in 2003 i was wrongly convicted and jailed for gbh on a child. my wife at the time had set me up as she was having an affair with my mate. he had bruises on him but these were caused by her partner. would that go against me and also benifit overpayment. i really want to do this but need some advice

Hi I was convicted of benefit fraud clearly because they thought I was spending the rent as the landlord was my brother but I wasn't spending the rent but still it went to court I got a job as carer and my dbs check was clear I then applied for another job I didn't disclose the benefit fraud as I was told it was civil matter not a police matter but now they have withdrawn the job offer as my dbs showed up there convictions im gutted and they didn't show up on last one .

Hi I have gone for a job in care which I already do with too other jobs had a dbs check done in December and came back clear.had a call from new job and they said it's been flagged and I have to wait for document to come In post then show them.i don't understand as it was clear in December and have no convictions or anything since last one ? There was an incedent with a neighbour who got into our house drunk trying to fight with my partner the police and ambulance were called and no statements or anything were taken and nothing more was said or done about it I just don't understand why it's been flagged ? Two years ago I slapped my toddler son's face as he was attacking his 10 week old sister with a seat belt strap. I disclosed this to a health visitor who reported me to the police who then cautioned me for Gbh.
Two years on my husband has volunteered at the school and the safeguarding forms have asked if he/anyone he lives with has ever received a caution/conviction for crimes against a child.
Will the school refuse his application if he discloses this to them? If he doesn't disclose it will it flag up on his dbs check?

It will show up on a DBS check. A standard DBS check will show details of spent and unspent convictions, cautions, reprimands and final warnings held on police records. Enhanced DBS checks show the same information as standard checks, plus any additional information held by local police considered relevant to the role you are applying for. Please also which tells you when a sentence has been 'spent'.

Hi I work for a teaching agency part time . I am also involved in my partners business where I am a premises licence holder and recently a member of staff sold alcohol to an underage person during a undercover operation - to cut a long story short I have been asked in a letter to accept a simple caution by the Local Authority as I was classed as Licensee. Will this show up on my dbs (I'm on the update service) even though I wasn't arrested by the police but interviewed under caution by the council trading standards? Bit confused by the difference between police caution and this simple caution from the council. We are a group of retired people who have formed a “not for profit” association to go into schools as volunteers and teach traditional dance. No one receives a wage but we ask for a contribution from the school to cover overheads and costs. As you can imagine, DBS testing would be a significant expense.
We understood that, as school staff will be present throughout and we are only occasional visitors, we would not be required to be DBS checked. Are we correct? We seem to have conflicting information on this.
If we do need DBS verification can we supply individual documents, if not would the verification have to be held by our association or some other body?
Most of our members are DBS verified with other organisations with whom they do voluntary or paid work, could these other DBS verifications be used without getting a new verification?
Finally, is there a time limit after which a CRB or DBS is considered out of date (I can’t find one). For instance, would an enhanced disclosure CRB issued in October 2008 be valid for presentation today?

On Monday 6thmarch 17 the rspca took me to court and was convicted of animal cruelty due to ex batt chickens dying.

Caught shoplifting. No caution or conviction but police involved and store took my photo, full name and home details. I don't know for sure but I assume the police also noted my details as well as the store. I received life time band from store and year ban from the shopping centre the store was in. I need to have a enhanced DBS check carried out for a new job I applied to which involves supporting people who believe someone might have experienced abuse. I am SO worried that the information about this shoplifting situation, which happened less than a month ago will show up. Is it possible for this to show up? Does the fact this happened less than a month ago make it more of a risk of someone disclosing this information from the police about this incident?

I worked as a TA for 5 years, but with a new Head Teacher staff left rapidly because they were being bullied. I reported what I has seen to governors who did nothing but it let some of the Head Teachers friends know someone was talking. Within months I was having problems but held firm and refused to leave. I was then accused out of the blue of Rough Handling, suspended then dismissed. There was so much wrong with how it was all handled/investigated but all evidence I supplied was ignored. I was accused of rough handling by moving a boys hands on his tray to stop him spilling his food. He originally had his thumbs on the bottom and fingers on the top of the tray. I moved his hands and a week later was suspended. The school then supplied the police with the information that I had been fired for Gross Misconduct due to Rough Handling and this has been put on my DBS. Will this appear forever? Will it only be seen on enhanced checks? Will it stop me getting any jobs with children or vulnerable adults?

My daughters Guides group has seen a prominent leader resign recently leaving just one adult to look after the group. To cover this shortfall and until a replacement 'suitable' adult can be recruited, the new leader has taken it upon herself to roster other another parent each night to supervise and help out. This has been done without prior consultation with the parents but obviously in order that the sessions don't have to be cancelled ufn. However I'm concerned as to who I'm placing the trust of my children with. What is the legal position here and do the allocated parents not have to have had police checks completed before being put into these positions of trust?

Hi, Please help - Having trouble completing an additional child safeguarding form from our local school. My wife is already DBS checked and cleared but the additional form needs a yes or no answer to the following question
'Have you ever been cautioned reprimanded given a warning for or convicted off - Any offence against or involving a person under 18? or any other relevant offence?

Should a suspension from work be considered a caution even though the issue was cleared? Suspended only while an allegation was looked (over 20 years ago now) into outcome no blame/offence found.

I was accused of multiple abuse charges against a child but during the course of my trial all charges were disproved.i pleaded guilty to causing unessasary suffering to the child in question because the child burned there self on an electric fire while I was tending to my six month old, is was proven to have been an accident but on my DBS the police have painted me to be an animal by listing all the accusations. 14yrs ago I was given a 12mnth suspended sentance, 12mnths rehabilitation order and 60hrs community service. This was because my daughter has sustained a greenstick fracture. I was charged with abh without intent due to the fact other factors ie: her jumping off furniture could have caused it or played a part in her injury. I recieved this conviction because I had stopped her from removing a soiled nappy and was deemed a factor in causing her injury involuntary.
The judge preceding did state he didnt think I was to blame but cps and probation offered a plea of abh with probation instead of mandatory sentance and the uncertainty of Crown Court.
At no point did I have my children taken away from us and was infact commended by social services on our overall care and parenting of our children.
Im awaiting my dbs check so that I can help voluntary coach children in football in our community and also to go for my grassroots level 1 coaching badge.
Im seriously worried that I wont be able to do this voluntary coaching due to what happened all those years ago.
The Secretary of the football clubs knows my past and circumstances involved and understands what went on. But Im scared I'll lose this chance as I could be put on the barred list. I have no convictions before or since this incident. Will this help to determine if I will be on the barred list due to no other convictions and the time thats elapsed.

Hi, I was invited to the police station today have a voluntary interview about false allegations of child abuse against myself and (mainly) my partner for an incident over a month ago which was embellished and manipulated by the angry ex wife. She has used the kids as a weapon in a 3 year ongoing access court case initiated by my partner after she stopped him from seeing them for 3 years. I start a new job at a school on Monday as a secretary. Do I tell them? Neither of us have been charged. We have been extremely honest and open that no abuse took place and given statements and we were released straight away. The detective said she is gathering evidence to give to CPS. My lawyer thinks it will be a weak case and thrown out but can the detective call my employer and tell them what's happened? I'm devastated! Help :(

my children's school accused my husband and I of neglect. it was not true. we had 1 visit from social services who then said no everything is fine at home but at school my son who has adhd was not being supported correctly. we had a cafe in place till he moved schools and his new school felt he no longer needed it. is this why my dbs failed?

The police can disclose information towards a DBS check which they think might be relevant to the job you have applied for and ought to be disclosed. As specified in one of the comments below, the scope of the information can very broad; any interaction with the police, whether or not it led to you being arrested or charged may be disclosed on an enhanced DBS check.

When I was 17 I pushed a 15 year old and threatened her because she told people I was a drug dealer and had people knocking all hours even one forcing their way in so can imagine why I was angry. She said I had her by the throat no marks to prove this lie althou I may have push my arm against it whilst I had a go. Year goes by I got arrested for common assult I was now 18 she was I believe now 16. I got a fine and probation for 12 months and put on a schedule 1 offenders list I believe they said. I want a job as a teachers assistant, I have 3 kids now 33 even was offered to adopt my sister child and temporary fostered another sister daughter. Now I'm worried when they do the check!

Hi, I have a few assault charges from my childhood and when I was 17 I was arrested for GBH. The court case went on for a while, I was 18 when I was given 6 month imprisonment suspended for 2 years. The judge made it very clear that although I was now 18 it would still be dealt with by youth offending and that everything is to be dealt with as though I was under 18.

I'm now 29 and have not offended at all since my GBH charge when I was 17. Would I still be barred from working with children or vulnerable adults? I'm a very caring person and would love to help people, however, I fear that my mistakes as a youth may haunt me forever.

If you were convicted in 2009, then your conviction will not be spent, therefore it is likely to come up on any DBS check. You are more than likely to be asked on your application form if you have been convicted of any crimes and you will have to answer this truthfully.

You would have to have an enhanced DBS check to qualify as a social worker. You don't say what your offence is, but any offence is likely to come up on the check and you would also have to reveal it on your university application.

hi, my daughters girlfriend is at college studying to work with kids, she has never been in trouble with the police until now where she was defending my daughter and has been charged with assault, she has not been convicted of it yet, but the college are saying that she will not be able to go out on placement as no 1 will take her now, and her funding will also stop, they say she can still do the theory part of the course but wont be able to do the practical side which will mean she fails the course, the case is at a justice of the peace court and not the sherriff court, can any1 give me any advice as she is heartbroken over this, thanks!

She has had previously to my partner being with her had her kids taken of her by social but then had them back then when he was with her she was not very nice to the children and social came back into the house for more checks

My nephew has been working in a summer school in france that is used by English schools and realised last week that he should have a dbs and his company cannot have done this,cos they have never asked for his permission or details. I handed in my resignation last month to my workplace which is a local authority after I endured some brutal and volatile behaviour from a young person who threatened to physically hit me, which happened early that month. I didn't feel safe or supported by the service after this incident so resigned. I then got a letter of misconduct investigation against me while I was off on stress leave during my resignation period. The claims were i didnt state to my line manager of my alleged absence after the inicdent and my alleged behaviour towards a young person. These claims are unfounded just to make this clear as I have a mountain of evidence to prove my innocence. But my question is if they don't find in my favour, can they place this on my DBS to stop me working elsewhere?

When I was a child, I think definitely below 10 years old, I remember being in year 4-5. So, maybe between ages 7-9, I have no idea, I was in primary school. I took a creme egg from a shop and the police were called and all that happened was they took me home and told my parents but I didn't see any paperwork being used, just a chat. I hadn't been arrested or charged with anything or even received any letters or paperwork from the police afterwards. I was in a bit of a state because I didn't realise it was so bad at that age and when the police came I realised it and thought my parents would be so angry. The two police officers were nice to me and said it was fine they'll just let them know why they've taken me back. I got taken home, they spoke to my parents about what had happened that was it.

I'm 19 now, in medical school at a top UK university. I applied for, and accepted the offer of employment, at a domiciliary care company (subject to a reference and DBS check). I've never had one before and I'm so scared and worried that the little problem from that night will show up. I will be so ashamed and embarrassed. Apart from taking the creme egg I've never done anything against the law in my life. The police didn't record anything as far as I know but they might have done it at the police station? I can't remember if they did any paperwork at the shop?

If I haven't been given any paperwork or letters regarding it ever since it happened or being charged, arrested or sentenced, especially at such a young age, will it show up on my enhanced DBS check?

I have been dismissed from my workplace as the allegation was not following the care plan and using family member of manual handle. It was end of the shift I was tired exhausted I went to patient room to check her and found her daughter was there who actually very much involve taking care of her mother. I was supposed to use Arzo hoist to transfer her from wheelchair to bed. It was my lapse of momentary judgement I asked the daughter to put her in to bed and she gave her consent .the patient was not heart nor injured but the daughter complained in CQC as a result hospital dismissed me. Definitely they will notify this to DBS but my question will it effect on my DBS report as the DBS customer care said I don't need to inform anything . It won't show up . But I am really confused . Will it cause Barr my job any where ?

a few months back i was arrested for criminal damage and gbh. it was one big mess of a night that included me and my stepdad, it was a very drunken night in fact! my stepdad did drop the charges and i was out of the prison the next day, so i wasnt convicted or charged for any crime.I am applying for college soon doing a young persons education course, the course requires a enhanced dbs check. I am so worried and scared that the college will refuse me because of my arrests, and also be refused by future job aspects. Do you know if i will have any problem in this situation?

I hope you can help, I was convicted of driving with an excessive amount of alcohol in addition to driving on a provisional license in April 2008. I was 18 at the time of the offense. I was very silly, young and really shouldn't have been bought a car for my 18th birthday before passing my test, that party I attended and the beautiful new car parked on my drive, I couldn't resist.
On the bright side, I have grown up and 11 years later I now work in a school and have done so for 4 years. I have just had my dbs back with a caution from 3 years ago stating assault/I'll treatment/neglect/abandon a child//young person to cause unnecessary suffering/injury. I was punched in the face by someone below 16 who looked much old and was bigger than me. My reaction was to slap that person though it was more shock than anything. I'm not a violent person hence why I couldn't believe I'd done it. I immediately stood back from the situation and admitted what I'd done. This resulted in a caution. My ex wife rang the police and told them I had physically abused my son and daughter when I had them over night after we had separated it was total rubbish and was being very nasty after the split, any how I received a phone call from a detective and was told over the phone what was going on and was told a date I had to attend the police station so I instructed a solicitor and i went to the police station on the specified date along with solicitor, I was then told I was being arrested, I was then questioned by detective about what she and my kids had said I was told to say no comment until my solicitor could find out what it was I was being accused of, he then told me to answer the questions which I did and it was a joke, I was then bailed but I had been suspended from work as I was a residential child care worker which I loved and my ex wife new this and new what would happen, then a couple of weeks later the same detective rang me up and told me that there was no case to answer and the cps were taking no futher action, I was then called by work and told to return to work and the suspension had been lifted, I want to know if the arrest will show on a DBS as I want to return to work with children in care, thanks

I'm beyond stressed with what's happening, I have been working at a stables for a year now and after passing Bhs stage 1 my boss has requested a Dbs check , I'm 34 now but when I was 17 and under I have a serious amount of arrests and a few convictions verying from soliciting , criminal damage , assault , theft , theft through deception. I'm stuffed well and truly worst thing is I suffered at the hands of the government was in and out of care from a baby and was forced into the streets to perform prostitution I was raped and had to suffer an abortion at 15 I reported it to police and it was investigated to be dropped , I'm never going to be happy I'm a risk from the lists I have checked yet I have a 14 year old and a four year old and not a danger to them , is there anyway I can challenge this will I have to live with ptsd and depression forever am I never going to be able to put my awful past behind me I was a victim acting out with no real help is my career in the equine industry over now total heartbroken no faith in nothing left please any help advice ???

I am a U.S. Citizen looking to work overseas. I'm a certified professional teacher (with licence) and have applied for a teaching job at a School in England. I have a U.S. federal arrest record where I was falsely accused and charged with possessing inappropriate pictures of children. The accusation was proven to be false and all charges were completely dismissed. I HAVE NO CONVICTIONS. I have the dismissal notice from the United States Federal Magistrate Judge and my teaching license has been reviewed and deemed valid by the licensing board. Unless you are videoing children or vulnerable adults on location at schools, play groups, activity centres, churches or other religious buildings etc, then you would not need a DBS check. However, some professionals undertake a DBS check for their own peace of mind, should an enquiry to record such an event occur.

It depends whether there is a clause in his contract that says he has to divulge a criminal record by association. Staff can be disqualified from working in a school or with young people if they live or work in the same household as someone who is barred from working with children or young people, even if they would not otherwise be disqualified themselves.

My girlfriend has recently started child minding self employed from her home. She has asked me to move in and do a DBS check. I do have a criminal record for a common assault in 2012, and some some previous spent convictions from when I was a teen. I have since not been in ANY trouble whatsoever and am in full time employment. Will I pass the DBS check to live with her?

I was convicted as a teen for robbery as part of a "gang" all receiving equal responsibility as I was present. It was a non custodial sentence and was spent in 2010. I now want to apply for a midwife course will I have to declare this as I was under age? And will it show up on a check?

Hi I was caution with theft in 1983 then driving a car with no license in 1985 then theft false accounting to a employee in 1990 no prison just fine and community service I haven't been in trouble with the police I was young and stupid I'm 46 now just applied for a porters job at a school what's my chances. I did work at a school as a porter and they were ok with my previous conviction as it was such a long time ago

As a trainee-teacher or teacher, you will be subject to ‘enhanced’ Disclosure & Barring Service (DBS) check by your potential university or training provider, so unless the conviction is spent, then it would show up.

If you received your caution when over 18, it will take six years to non-disclosure from date of issue (as long as it does not appear on the list of specific offences which must always be disclosed). If you were under 18 at the date of issue, then it would take two years until your caution is spent.

In 2014, the government issued supplementary guidance to ‘Keeping Children Safe in Education (2014)’ which stipulated that school staff would be disqualified from working in a school, if they ‘live or work in the same household’ as someone who is barred from working with children or young people. As a result, many people were dismissed under the legislation and it caused a lot of consternation. In 2015, the legislation was changed. You can see this new legislation via the gov.uk site here. Hello my wife has worked at a pre,school for 10 years, she has no criminal convictions, no cautions, nothing at all, has always passed all legal checks. A conviction received when 18 or over will not be disclosed only if: 11 years have elapsed since the date of conviction; it is the only conviction on record; and it did not result in a custodial sentence. Even then, it will only be filtered if it does not appear on the list of specified offences which must always be disclosed, see Unlcock whichFor a conviction received when under 18, the same rules apply as for adult convictions, except that the elapsed time period is 5.5 years. I am a hard working mum to 3 children and this record does not show a true reflection of what person I am at all. Hi, I am driving myself insane atm. I got myself into a bad patch in 2009, single teenage mum with a baby and depression and I gained a caution for child neglect due to poor home conditions. It is my one and only offence, I'm not on the barred lists, I've never had my children removed and have been cleared for volunteer work. I've been working my but off at college to get the qualifications to become a midwife for the past 3 years, now I've applied for uni and my caution is causing me problems. They're saying that they're worried about my employability. I've Googled myself to death and read loads of legislation and still can't find anything relating to my chances of employment, can anyone advise me please what are my chances at gaining employment in the nhs?

My daughter has an enhanced dbs for fostering and adoption which we renew annually and is currently in university doing a degree in primary education. Her university have accepted the dbs and have made the appropriate checks but a school where she is doing a placement have told her she must have a separate dbs for teaching (a problem which nobody else seems to be having). Is this correct?

In 1991 an 1 conviction under the theft Act 1968 for handling fine £100, compensation £8 and Attempt / obtaining property on deception cost £20 FIne £100.

Hi I was studying childcare in the early 2000's and no issues getting a CRB for college. I didnt continue into childcare evem though I passed my 1 year course (NVQ level 2 in childcare and esucation). Met my bf in 2003 and he also as far as I was told had no criminal record but in 2008 was charged with harassment whilst im a relationship with me (ive been told was seeing someone, her bf found out so she told him she didn't know who my bf was and he was phoning her all the time so her bf got her to involve the police resulting in my bf being cautioned).....will this show up on my dbs if I want to volunteer at our child primary school???? Please help as ive want to volunteer for the last 2 years but dont want the embarrassment of his caution back in 2008 showing up on my dbs and therefore have put it off n off

Hi I was offered a job as a bank staff in my local pre school. But recently showed them my dbs and the pre school say they have to contact the committee and have a talk also they need to contact oftsed. You should normally receive a copy of your DBS check within four weeks. However, the gov.uk site states at certain times of the year, the DBS has a backlog of applications to process which may cause a delay in their response. I assume this is because it is the beginning of the new school year and many others may also be having the same issue. Have you called the DBS helpline to query it? To become a social worker you will need to study a three-year undergraduate degree or a two-year postgraduate degree in social work that is approved by the Health and Care Professions Council (HCPC). You will also need to pass background checks by the Disclosure and Barring Service (DBS). The enhanced level DBS check is the highest level required for positions that involve caring for, training, supervising or being in sole charge of children or vulnerable adults. It means an enhanced DBS check will include details of all convictions on record, whether spent or unspent under the Rehabilitation of Offenders Act 1974. This means that even minor convictions, may be included on the disclosure, which would invariably affect your application.

Hello, we are parents of a disabled child. We want to employ a Nanny who is an American Citizen, but has recently moved to Scotland and married a Scot. She has provided contact details for references from America, where she did relevant work.
She has also provided a copy of a State of New Jersey approval for school employment from the NJ Criminal History Review Unit (10/3/2012).

What do we need to satisfy ourselves and yourselves for her to be able to Nanny for us?

Many employers conduct criminal background checks by asking applicants to consent to a basic disclosure of all unspent convictions and cautions - only if your conviction is spent will not show up on a basic disclosure. However, if your employer requires a standard disclosure or an enhanced check, then this will show all convictions and cautions (both spent and unspent). An enhanced disclosure is usually required if you will be working alongside children and vulnerable adults.

Intelligence held by the police may also be included if the police reasonably believe it is pertinent to a recruitment decision. Hi, I have been in a residency battle for over a year. This led to social care involvement under child in need to assess concerns that my ex husband alledged. It was all found untrue apart from one occasion when I slapped my son for something that he did which was very shocking. The social care report said that I physically harmed him on this one occasion although they andthe judge understood my reasons, there was no bruising and it was agreed that I regretted my reaction immediately as I have three children and that was the only time I have even tapped any of them. Will this show up on my enhanced dbs? I work with children and young people and am half way through a diploma in play therapy so I could well lose my career for one regretted incident that didn't even leave a mark. No action was taken, and the children were not considered to be at risk. The child in need was closed immediately after the report was submitted.

My son has just received his CRB check back. He has a charge of battery on it from when he was with his ex wife in 2013, will this effect his chances when applying for school work? It shows that he did community service for his conviction. It has nothing on it about children and he is also the full time carer for his two son's.

I should check with the school directly regarding whether or not your employers should undergo a DBS check. However, as a general rule checks would not be required if there is no contact between contractors and pupils, for example if the contractors are working on a separate site to the main building, or outside school hours. A suitable risk assessment will be undertaken by the individual school/educational establishment.

I recently took up employment as a Practice Manager of a Doctor's Surgery. The doctors have asked all new employees to pay for their own dbs check. They do not reimburse us. On the basis of the information you show above, it looks as though they have the right to ask us to fund the check, but should reimburse us the cost if the check is clear. Do they have the right to refuse to pay for the check and to insist on their employees funding their own checks? It should also be noted that most people who work for this Practice work only part-time, some as little as 12 hours a week and earn very low wages.

I was employed by an equestrian centre recently where staff have unsupervised contact with children. I enquiried whether the company do CRB checks and was told no as it's too expensive to get all staff checked. I mentioned it's a criminal offence to employ someone with unsupervised child contact to not get CRB clearance. I was sacked soon after and I have concerns this company are running unlawfully. Hi . I have applied for a kitchen supervisor job in a secondary school . But I have had to write down my comvictions and a caution . My 1st conviction was 2007 ABH this was through domestic abuse by my x-partner I was safe guarding my children against him.

My 2nd conviction was April 2014 . A road rage incident were my son was attacked and he managed to come and get me . I was arrested and got a conviction for reckless assualt as I touched a woman's hair and sunglasses on her head as a result of her trying to hit me . Her glasses were not dislodged from her head or broken in No way . But now it is believed this was coax and something to do with my x-partner as it was our daughters birthday at the time .
Caution was in June 2012 where I was cautioned for harassment as my x-partner would not return my children so as a worried frantic mum I was constantly texting and calling him to return my children to me as at the time there was a court order in place which he broke .
These convictions and cautions I can have backed up by esdas and and social services as I was under then at the time for help . As these are only due to me safe guarding my children by a violent x partner .

I have now in place a non- molestation order with a power of arrest against my x-partner as in jam 2013 he was convicted of child abuse mentally n emotionally n phyiscally towards our children so he is no longer allowed to have no contact wot so ever and have a distance of 250 meters where he is not allowed to come no where near me , my home , family or my work place .
Now big question will these convictions and caution stop me getting the job I have applied for ??? Many thanks Sonya

@norms - If you are applying for a job that is subject to an enhanced DBS check, you are under no obligation to disclose information relating to allegations, arrests, 'no further action' outcome, not guilty verdicts or any other matter that did not result in a finding or acceptance of guilt. However, it may be disclosed on an enhanced DBS check.

I have just got my check back with assault on police on it, I touched the officers arm & she said it was assault this happened in 2011, I was never charged with this & it was not took to court so why did it show up,I lost my job today due to this as i was a cook in a nursery,I have no other record,I thought after so many years it would of been took off as there was no charge,the reason I lost my job was cause it all goes threw social services cause I worked with children & they say any kind of assault is a no no

@Zac 1984 - yes, I'm afraid you can be disqualified from working with children if you are living in the same household where another person who is disqualified lives or is employed. It comes under the 'disqualification by association’ regulations.

Hello, my husband assaulted my daughter and myself in January and was sentenced to 16 weeks imprisoned suspended for two years , then also found out he has previous DV and assaults, I am looking at working with children and have heard that even tho I have a clear DBS if I lived with someone who had a barred DBS I would also not be aloud to work with childlen. Can you confirm this , and a reason to help me understand ? I am looking at 18 months down line at giving him 2nd chance if he has taken all the help and proved he has changed...thanks in advance

@flo - you don't say what your conviction was for, but the fact that you were dismissed for gross misconduct is not going to look good when you apply for future jobs, and you will also be asked about convictions etc, so you would have to be honest.

@Goldilocks21 - Although cautions are not classified as a criminal conviction, they will show up on a DBS check, especially an enhanced one. However, as a rule employers will generally take into account the type of offence and how long ago it happened.

Can you please help me I received a caution for deleting my sisters e-mails I had her password and everything. I deleted them as she was being really nasty about me and my other sister, all about money as my dad had not long died. Wasn't really thinking properly just wanted to take the smoking gun out of her hand (as the emails was her choice of weapon) so deleted all of her contacts and emails. She in turn reported me to the police, I admitted what I had done and was cautioned for it. Will this stop me from being an occasional helper for the cubs that my son is in??? I am planning to work in America this summer at a children's camp and have completed all paper work required and even have my visa. However, my CRB check has not come back yet. Aged 14 (six years ago) I received a police warning for shoplifting, and was told this would disappear when I was 18. Is this stopping me from getting my CRB back? I have just started a job as an after school cleaner works perfectly around my child and am very grateful to get back into work so quick.... I had to have a dbs check and am so worried around six years ago I received a caution I took for an ex (bad idea I know that now) only im worried sick this will show up it was at the road side and never have I ever been into a police station, arrested or been to court. I have recently been dismissed from work for gross misconduct. I work in a nursery and a parent made an allegation which the company has believed her over me. Of course I am going to appeal their decision, however if I loose the appeal I believe the have to refer me to the DBS. @Fred - it depends if you are working with children as the incident may impact on your working life. Last year there were changes made to childcare disqualification requirements for schools, which means the new regulations prohibit anyone who lives in the same household as a disqualified person, from working in a relevant settings, including in schools. I received a caution around 97/98, I have no idea the exact date or what it was for. My then boyfriend and I had been arrested for rowing in the street so I don't know what type of caution (if they are given names?) is. I was convicted numerous times for soliciting for prostitution i even went to prison for it.....between the age of 16 to 20.....turned my life around left the man who put me on the streets. and never looked back.....but now age 56 been asked to do an DBS check for work as a cleaner in a university.... will it show all the charges and sentences or because last time was 36 years ago it won.t....worried sick.......

I was working voluntarily at a school and have now been asked not to return as I have two 20yr old convictions. One for public disorder and the other for entering a non dwelling premises. I disclosed this to the school and they have refused me working there from that. I really didn't think this would affect me working in a school, does anyone know if this is correct procedure or discrimination. I get safeguarding children but these are childhood offences.

My husband has a section 18 from over 11years ago. He recently had a career change working as an RCW with young offenders/children in homes. He had a DBS done and went on to be employed over 5months ago. Ofsted have recently been in and now his bosses say he has to leave as he is barred (1st we have heard). Who is in the wrong? Is it the company which employed him despite knowing of his past? Thanks.

Last year I was arrested for thrift upon finding and assault. I never assaulted the girl I was breaking up a fight, the theft however was because I found a bag and the girl accused me of stealing her bag when she left it there and I wasn't sure of her character so refused to give her the bag when there was no id within to prove it was hers. Therefore the unfortunate incident occurred where I was arrested for theft. The girl decided to tell the police that it was me that was in the fight not my friend which was untrue. I pleaded not guilty, after, the police offer and my solicitor presented my case to the crown court who dropped the case as they believed that there was no suffice t reason to continue it as I was not guilty if it. ( you may not need to know all this) so I don't have any criminal convictions. I'm applying for a primary teaching job which has an enhanced dbs check. I'm scared that this will show up and affect my chances of getting a job as I am entirely innocent. Do you know if this would show up?

I had my DBS done in nov I've passed stages 1,2,3 and have been stuck at stage 4 since 20th nov. I started my new job on the 5th jan now I'm chasing DBS with police daily and knocking my head against a brick wall!!!! In the meantime work have now said their fed up of waiting and I may lose my job. So annoyed

My husband is on the SOR for 6 months until spent, and I'm trying to find out if I have to tell my employers. I work in a childcare setting. He will never attend my work place and I myself am never left unsupervised. Ive had an enhanced dbs check, which came back clear, and have also been told by our visitation officers that his conviction(13+years ago) would not affect me getting a job in childcare. Ive had 3 since knowing him. In interview and application I was not asked about partners or relatives convictions. I have not lied at any point.

They may not have to have a DBS check if the parents are present when the class takes place. But it is always advisable to have one, just to be on the safe side.

I work for a big company that provides meals school children. We cook in the school kitchen on the school premises and serve the children - we have close contact with the kids. One of the dinner ladies does not have a DBS chack and has been working for the company for about 3 months - is this against the law?? The rest of the staff all have DBS checks.

I received my form today and am really worried. I began helping out at my daughter's school almost ten years ago, finally enrolled on a college course in 2012 and did my placement at the same school. Since qualifying in January 2014, I have continued to work voluntary as a teaching assistant (5 days most weeks). Since October 2014, I have been getting paid for 10 of those hours. My problem is that in 1978 when 15 years old, I had two convictions for theft and one for arson. As these happened so long ago, would they still be grounds for disqualification ?

My 23 year old son had an argument with an ex girlfriend and accidentaly broke her glasses. She went to the police and he was chrged with criminal damage and common assault. It appears he will be found guilty. He has a sports degree and wants to ge a PE teacher or coach. Will his future plans be in tatters due to an argument ?

Hi, I have misused alcohol in the past and ss have been involved on and off over the last 3 yrs. i have 2 children on my own, aged 9 and 13. After 6 months of sobriety, i fell apart in september for a month after some bad news and ss were back involved. i sorted myself out and have been going to AA and staying sober since. 2 weeks ago, I drank for one day, felt terrible for it and rung my SW and my father to colllect the kids from school. i am now facing a child protection consultation next week. up until 2 yrs ago, i have always worked in pre-schools/nurseries/schools etc. working with kids is my dream job and i am studying for a degree with the open university in childhood and youth studies. my dream has always been to qualify as a professional teacher. My 13 yr old went through a period of refusing to attend school and last April i was up in court and given a 12 month conditional discharge. there is a possibilty of returning to court for the same offence b4 that yr is up. If we end up on child protection, will i ever work with children again? Also, with being in court for the non attendance, will this affect it too? Thank you.

Please help me I have been acoused of shoplifting two days ago at boots for £1,75 nail clipper after I was just spent £25 in the store and I stupidly put in my bag and thought I will pay for it later and by the door I have been stopped by the security and I tried to explain that I did not meant and I was not sure to get it or not and I bagged him to allow me to pay for it and let me and to pay even charge for the store to allow me to go but they called the police and they come to the store which they take my details and done criminal check and he said I'm afraid you used to be a good chartater pervoiusly not anyone and said I have two option to accepting being quilty and sign a statement or to go to the the police station to be held in a cell so I sign I was panicking and crying so I sign the statement .the store said they will not place any charge but banned from the store and the police officer said that to place donation to the store and I volunteer wanted to also pay for the nail clipper which I did.
I know I was completely stupid not sure how I was thinking and I wish I can reverse the time I have not slept since I wish I sleep and never wake up again. I not sure what will happen. Will this appear in my CRB check as I work in accountant and was going through job moving .please please help me I'm getting crazy .

I very stupidly drove a few weeks ago after having a few drinks, I got stopped by the police and was found to be over the limit. Consequently, I face a ban and a fine by the court. I am mortified, never been in trouble with police before. I work as a TA and am worried about the consequences of this on my future career. It was my plan to do a PGCE next year. Have I jeopardised this?

I have been a primary school teacher for 16 years and my husband has a criminal conviction from 13 years ago.
We haven't had to complete the forms yet, however when they do come into school, can I refuse to complete it?

I'm due to get married next year and my fiancé has a spent conviction for common assault. I'm also due to start my teacher training this September. So according to this new legislation I'm going to be disqualified before I've even begun! Can I apply for a waiver now? Or do I need to actually be disqualified before I can ask for forgiveness for a crime I didn't commit? The other problem we have is that he was hoping to train to be a PE teacher in a Secondary school and have found no reason why he couldn't be as they would be over 8 years old, but what is your understanding of this? We don't live together as he's in the RAF at the moment so we need to be married before getting married quarters. Any advice would be helpful before we spend thousands on training for careers we can't have.

I am a teacher and we have recently been told we will have to fill in the new form about the criminal records of anyone living in the same household and the implications that should they have a criminal record we could be disqualified from teaching. My partner has spent offences which were committed 15 to 20 years ago. Will these offences disqualify me from teaching? How are they checking the status of people in our households? This is of great concern to me.

My partner has had a similar issue, in her case as a result of a caution accepted in 2005. Having read the regulations, it is clear she should not be disqualified, I'l copy the relevant section for you, it depends when the caution was, according to the regulations, the caution must have been issued after April 2006. at least that is my interpretation, maybe someone else could read and see if they agree. section d refers to cautions. We will try to confirm it Monday.

(2) In these Regulations a person has been “found to have committed” an offence if that person has been—

(a)convicted of an offence;.

(b)found not guilty of an offence by reason of insanity;.

(c)found to be under a disability and to have done the act charged against them in respect of such an offence; or.

(d)on or after 6th April 2007, given a caution(4) in respect of an offence by a police officer after admitting that offence.

(3) In these Regulations a person has been found to have committed an offence that is “related to” an offence if that person has been found to have committed an offence of—

(a)attempting, conspiring or incitement to commit that offence; or.

(b)aiding, abetting, counselling or procuring the commission of that offence

I have worked with children for many years but recently at work we all had to fill in a new annual Suitability To Work With Children form. It asked about people you live with. (I haven't had this asked on other forms) I told the truth and declared that over 11 years ago and before I knew him that my husband was convicted of Common Assault. I now find my self sat at home after been asked to leave work this morning until they sort it out!!!!!!! I don't no what route to take or what I can be doing to help myself. Please off any advice.

@Katya Items that do not show up on a standard level check, may show on an enhanced DBS check. On an enhanced DBS check, the police have the power to include any information they hold about the applicant if they believe it would be relevant to a recruitment decision. However, you have the power to challenge any information revealed on your certificate before you show it to your employer.

I had a false allegation of assault made against me by a parent of a child I teach, the police did not take any action or even speak to me, I found put via my school (and that the same woman had made previous allegations on several other teaching staff)

Hi, I've been dating my partner for over three years, but recently we moved in together, it seems an allegation was made against him in 2004, when he was 14 no charges were brought, and evidence at the time disproved the allegation...... Now the nursery where I work have done new DBS checks and this is showing up on my DBS, I've now been suspended as of yest!! .... And today told I'm not to have any contact with staff from work and suspended again for Monday!! I'm at a loss as A- I've worked at the nursery for three years and I've not comited any offence.B- I've spoken to his parents who confirm he was innocent of all alegations and no action was ever taken C- he has no contact with nursery or any child in it!! So where do i stand?

I was in an abusive relationship some years ago and the police had to be called. My children were present, but not harmed in anyway by their dad, as I was the person who got physically harmed. I will be Enhanced crb checked, as I want to work in a school. I was wondering if this would show up on the search and if it would have any problems with me getting the job. I have never been arrested or given a caution for anything. I was only told by Social Services to not have contact with the father of my children and instead drop them to a relatives home if he wanted to see them. I hope this helps.

@Shell - Every organisation that has contact with children and young people, have to make sure that the people you recruit are suitable to work with children. You would have to have a DBS check and it depends what that brings up.

@sammy As a rule cautions, final warnings or reprimands will not be disclosed on a standard DBS/CRB check. It includes cannabis warnings (usually issued on the street). However, as local records, they may be disclosed on an enhanced DBS check at the discretion of the Chief Constable. If you want to find out more the subject access provisions of the Data Protection Act 1998 gives individuals the right to have a copy of any personal data held about them. You can apply for a subject access request through the Public Access or Data Protection Office of your regional police force headquarters. The forms are usually available to download on the relevant police force's website. You can also request a copy of your Police National Computer record, which will provide details of all convictions, cautions, final warnings and reprimands held on your police records. This is the information that will definitely be disclosed on standard or enhanced DBS checks. If you would also like details of your local records, which may be disclosed on enhanced DBS checks at the discretion of the Chief Constable, you can apply for your 'full nominal record'. I hope this helps.

hi i applied for a care job where the company sent off for my enhanced crb they are waiting for me to start work but i been trying to find out why its not come back yet when i phoned the crb place they said police can hold it for 60 days but thats rarely happens they had it since 4 aug and i want to start work could i just get a basic or standad one online witch take 48 hour just so i can start work till my enhanced one comes

Hi, I am a registered childminder who is in the process of setting up an after school club.I have just recieved my dbs check for running the club.
I would like to take on a childminding assistant whilst waiting for my registration to go through and then I will employ the same assistant at the club. Will that assistant need two dbs checks or will one suffice.

@tres, it depends what kind of CRB check is done - basic, standard or enhanced disclosure. However, as more than 10 years have passed since his conviction then it may possibly not come up but because of the nature of the offence and the position applied for it may be relevant for the employer to know.

@qwnb, that depends on why your children were taken away from you? I'm not sure if this will show up on a CRB but it could possibly effect your chances of working with children. You could ring the citizens advice and ask them.

Three questions:

1. Is it legally required to have a CRB if I would only ever be with a group of under 18s with a qualified teacher present? Or is it just best practice?

2. What's the difference between CRB and DBS?

3. Is there any point if they are out of date the moment they're printed (I could have one dated today, commit a crime tomorrow and an organisation would know nothing)? Also, I don't see how helpful they can be if they print every petty incident including unpaid speeding tickets but someone like Jimmy Saville who was never convicted while alive could have got a clean CRB. Flawed system.

HiI run boat trips at Mersea and both children and parents are out on the boat together so I presume I don't need any checks to take them out. However I am looking into doing a children's club out on the boat 1 hour each week and teaching them different things about boats every week and making up activity packs etc, give the parents an hours break while the children come out on their own with me on the boat. What checks do I need to have done to comply legally to take the children? Do I just need a CRB check, what is a DBS check - is that instead of a CRB and ISA check? I am licensed to take a maximum of 12 passengers on my boat, would I still be able to take 12 children or is there a max number of children per adult rule? I have my legal liability insurance, all the relevant licences for driving the boats, boat licence and survey, first aid, sea survival, fire fighting courses etc.

I'm starting up a new business. Its an indoor play area for children with slides, frames and cafe. I would like to know if there are any child protection regulations i need to adhere to. The parents/guardians of paying children will be solely responsible for supervising their children whilst on the premises (with lots of signage to this effect also). Myself and my staff will be manning the till, reception area, cafe and cleaning up. Do we have to be legally checked for convictions etc for this role or not? Thanks for your time.

I was harrased by my ex partner for twelve months after our relationship ended. There were never any witnesses so he was never charged. I bought a car from hiss work colleague but i was giving my partner at the time tha cash to pay for me. The balance was paid and the log book was in my name. When we separated my partner took the car because i hadn't passed my test. I didn't give him permission to take the car and this was how he so easily harrased me. I would not leave the house alone as i was petrified for me and my son. As i went through counselling and became stronger i began to leave the house and even started going out more often at the weekends. My ex would alwys know where i was and would harrass me in nightclubs or once i had left. On one occasion he left MY CAR parked outside the nightclub and i was so angry after he had spat and my friend and i that i kicked the wingmirror off. Yes there wer witnesses and i was fined. Even though this was my own car which was thieves from me and may i mention that when i reported the car to police they told me i would have to take it to a civil court. I was extremely vulnerable at the time and had no confidence in the police. I was terrified for my life for a number of months. Anyway this was five years ago and i have since got a new partner and had another daughter. I now go to college and would like to study social work at Salford university. I am just wondering if i will have to explain all this in my interview and as far as my CRB check is concerned? I hope that one day i will be able to leave my very upsetting past behind me. This is the only thing i have ever done and been introuble with the police for. Shall i forget my future in social work?

He has also worked for the council and had a crb check done there. As he is setting up his own buisness how does he stand if you cant get your own crb check.

My partner is thinking about leaving her child care job and, starting looking after children at home. About 8 years ago I was arrested twice in six months for fighting whilst drunk. I was given a fine for drunk and disorderly and resisting arrest. I wonder If this will stop her from having children at home. My partner has been accused by my ex wife of domestic abuse, this has been proven to be completley false and social services have takern no action after doing a section 7 report. During the cause of this a police check was asked for and obtained. She had an perfect record and has been working with children for twenty years and is worried that she will not be able to continue doing so.

@neve, you need to be honest and tell the manger about your previous conviction as they will find out when you've completed the CRB check. If you are upfront and explain to them what happened then you will have more chance of keeping the job. If you don't tell them and they find out only when they receive your completed CRB, then they will lose trust and faith in you as you failed to disclose it to them at the first opportunity. Only the employer can decide if the want to take you on, and your best chance of this happening is to be honest from the start.

I have been offer some volunteer work at an after school club which I would love to do as it means my son whos 7 can come along for free.The only problem is I have a criminal record the charge has been spent but I know it will show on a CRB I dont want to let the manager down but I dont want to take on the position if I will just be asked to leave when they receive the CRB. the charge was drinking whilst in charge of a child under 7 which im deeply ashamed of I was at a bbq and his dad failed to pick him up so I had to take him home I was violently sick and flaged down a police car to ask for help which lead to the charge. It was over 2 years ago an in which time I have sort help and turned my life around for myself and my son whos 8 now.does this mean I will never be able to work with children again?please help

Can I apply for a c.b.r check on myself as I work in entertainment and it would be really handy to have a certificuit to say weve had a c.r.b check. I work with mascots and I am quite often asked "Have you had a c.r.b. check done" and I have to tell them either no or it's upto you to get it done.So if we could get certificuit to say we had had the check done and have it renewed every 2-3 years or so it would save you alot of paperwork and you and the grief we get sometimes from angree parents. Also if this already exists then how much does it cost and how do we apply to have a check done on ourselves.Thank you Bennyboy

I want to apply as a private tutor as part of a national /international franchise, I been to court on a charge that was made up of common assault. This resulted in the very unusual case of the judge giving a guilty verdict against me but in view of good character references the judge passed an "Absolute discharge" award.
Any comments on this would help.

@Kel - I would have thought that your friends conviction would have come up on any DBS check. The fact that the Department of Education has changed the rules means a lot of people are going through the same issues as you because their partner has sometime in the past been convicted.

I am currently working towards my level 3 in football coaching. I have a placement at a primary school teaching 7 - 11 year olds football in a after school club. I have a safeguarding childrens certificate but would I need to have a crb and if I do where can I obtain one from as I understand a indiviual cannot apply for one.
